海上人身伤亡损害是海上运输业经常面对的问题之一,如何对海上人身伤亡损害进行赔偿也是当前学术界较多争议的问题。正确处理此类案件,对于保持海上运输业的健康发展具有重要意义。本文从海上人身伤亡损害赔偿范围、由此产生的精神损害赔偿,以及责任限制等几方面作以探讨,以期根据我国的国情,尽可能地找到一个海上运输企业和受害者利益的平衡点,为进一步完善海上人身伤亡损害赔偿的有关法律提供依据。
Loss of life or personal injury at sea is one of the legal problems existing in admiralty practice in China and solution of them is of significant importance. The thesis makes a preliminary study on the following aspects: the scope of compensation of such loss or injury and consequential psychic damages, limitation of liability thereof etc. in order to find the point of balance of the interests of the ship industry and the casualties in the light of the situation of China.
