农民工问题一直是我党和政府关注的焦点问题之一。农民工现象是当代中国社会发展的必然,他们已经成为一个不容忽视的特殊群体,成为促进经济发展的一支重要力量。但现实生活中由于农民工处于边缘地带,他们的合法权益得不到应有的保障。本文分为三个部分对农民工问题进行了研究,在较全面地综述了农民工历史发展的基础上,较深入地分析了农民工权益保障的现实状况及其成因,并进一步对解决这些问题提出了系统的对策措施。 第一部综述了农民工的历史发展。主要介绍了农民工形成的四个原因和农民工的人口、从业、心理特征,指出了农民工在社会经济发展中的积极作用。 第二部分分析了农民工的权益保障问题,主要指出了解决农民工的权益保障问题的重大意义,深入分析了农民工的人权和社会保障的现状,并且从制度和管理、立法及农民工自身等方面来论证农民工权益保障缺失的原因。 第三部分研究了农民工权益保障的对策,主要从户籍制度、就业制度、社会保障制度、法律制度、公共服务制度以及维权组织六个方面来论证如何保障农民工的权益。论文认为制度供给不足、不当和创新不够,是农民工问题产生的根源所在,并在此基础上,设计出具有可操作性的改革措施,来解决农民工问题,以实现制度公平,让他们享有平等的国民待遇,从根本上维护农民工的合法权益。
The problem of farmer laborers has always been one of the most significant issues that CCP and Chinese government are concerned with. The formation of farmer labors is an inevitable result of China’s development. They have become a unique stratum of great significance, promoting economic development in China. However, because of their comparatively subordinate identity in China society, their legal rights and interests are not sufficiently protected. This paper conducts a study on the problem of farmer laborers in three parts. On the basis of a synthetic introduction to the history of farmer laborers in China, a thorough analysis is presented, concerning the current problems of their rights and interests’protection, the causes, and systematic solutions to these problems. Chapter I is brief introduction to the history of farmer laborers in China. It consists of four reasons for the formation of farmer laborers and the characteristics of farmer laborers’population, occupations and psychological conditions. It also sheds light on the active roles farmer laborers play in China’s socioeconomic development. Chapter II is an analysis of the problem as to farmer laborers’legal rights and interests. It indicates the significance of settling the issue of guaranteeing farmer laborers’legal rights and interests. The human rights and current condition of social security for farmer laborers have been thoroughly investigated. Causes for the lack of guarantee for farmer laborers’legal rights and interests are also demonstrated from such aspects as system, management, legislation as well as the farmer laborers per se. Chapter III is the solution study for the problem of guaranteeing farmer laborers’legal rights and interests, from the following six aspects: household register system, employment system, social security system, law system, pubic service system, and organization for defending rights and interests. The paper attributes the original cause of the farmer laborer issue to the deficiency, the inappropriateness, and the insufficient creativity of system supplement. Based on this finding, the paper puts forward maneuverable reformative measurements in hope of putting an end once and for all to that issue, realizing the justice of systemsto ensure that farmer laborers can enjoy equal treatment, as well as radically defending farmer laborers’legal rights and interests.
