我国的基本国情是人口数量多,人均耕地少,农地后备资源严重不足,人地矛盾非常突出。如何提高土地资源的利用效率,尤为重要。因此,近年来,农地使用权流转方面的研究成为我国农村问题研究的重要课题之一。现在,我国正处于建设社会主义市场经济的关键时期。在市场经济条件下,资源由市场配置,具有信息充分、交易费用低、运行效率高等优点。农地作为一大生产要素,同社会上其他生产要素、经济资源一样,也必须在流转的过程中通过市场化来实现效益最大化。 本文首先回顾了国内外文献有关农地使用权流转的最新研究成果、我国农地使用权流转产生的背景及现状,并指出存在的问题及其产生原因,对农地使用权流转的影响因素进行了分析,并在我国农地使用权流转机制的构建对策中论证了当前背景下,农地使用权流转市场化是其必然的趋势,同时提出了完善农地使用权流转市场化的配套机制。 本文的主要结论是:(1)通过明晰产权关系,可以在稳定土地承包关系的基础上,促进农地使用权的市场化流转,实现农地的有效利用和适度规模经营;(2)必须剥离农地使用权的社会保障功能,建立起农地社会保障替代体系,与改革城乡二元户籍制度和二元经济结构相辅并行,使农户在社会保险、福利制度等方面与城镇居民享受同等的待遇。只有这样,农地使用权流转机制才能真正建立起来。(3)农地流转过程中,必须在保障农户农地承包权的同时,切实确立农户在农地流转中的主体地位;(4)在农地流转过程中,政府应转变职能,加强对农地流转的宏观调控。政府对农地使用权流转的宏观调控可通过制订正确的土地政策来实现,主要利用经济手段、法律手段和组织手段,按照土地配置的宏观效益,对土地流转的方式、内容以及流转的条件进行调控和制约。

This article first reviewed the literature related to farmland use rights transfer of the latest research results, China"s agricultural produce to transfer the right to use the background and status, and pointed out that the existing problems and their causes on China"s farmland use rights for the flow of factors the analysis, and in our country the right to use farmland transfer mechanism Construction response demonstrated context of the current situation, transfer of land use right market is an inevitable trend, and put forward sound farmland use rights transfer market-matching mechanism. The main conclusions are: (1) by clarifying property rights, land contract can be in a stable relationship on the basis of the promotion of farmland use right of the market circulation of agricultural land to achieve the effective use and appropriate scale of operation, (2) must be separated farmland use rights of the social security functions, establish a social security alternative agricultural system, we must reform the household registration system and the dual urban-rural dual economic structure complementary parallel, so that farmers in social insurance, welfare system and so on and urban residents enjoy the same treatment. Only in this way, farmland use rights transfer mechanism can really built up. (3) In the course of the circulation of farmland, farmers must protect the right to contract land at the same time, effectively established farmers in the circulation of farmland in the dominant position. (4) In the course of the circulation of farmland, the government should change their functions and strengthen the circulation of farmland in macroeconomic regulation and control. The government"s farmland use rights transfer of macroeconomic regulation and control is through the development of land policies to correct realized, mainly use economic and legal methods and organizational means, in accordance with the macro-effective allocation of land, the land transfers, as well as the flow of content conditions of control and constraint.
