煤矿安全规制，它是政府为保障煤矿工人在劳动过程中的安全和健康，在法律、技术、组织制度和教育等方面采取的各种措施，属于社会性规制中工作场所安全规制，与经济性规制一样，它是对市场失灵的一种治理。 随着中国煤矿重特大事故的此起彼伏，煤矿安全规制研究也越来越受到国内学者的重视。煤矿安全规制的目标就是“降低死亡率，提高工作场所安全”，然而现实中频发的煤矿事故，不得不让人怀疑煤矿安全规制的有效性。煤矿安全规制在执行中受多种因素的影响，如规制水平、就业水平、人均收入、教育状况等，而且煤矿安全规制内生于企业风险，并且存在佩尔兹曼效应，即工作场所安全规制增加，工人预防风险的意识降低。也就是说安全规制替代了工人安全预防努力，导致安全规制效果降低，同时刺激了死亡率的上升。因此，从这个意义上来说，煤矿安全规制效果如何并且在多大程度上影响了最终目标的实现以及由此而带来的政策建议，是一个颇有现实价值意义的研究问题，对中国煤矿安全规制研究也是一种有益的补充。 本文采用1978-2005年数据，基于VAR分析方法，对中国煤矿安全规制进行了实证研究。通过刻画煤矿安全规制行为与规制效果之间的长期动态关系和解释对方之间的相对重要性分析，证明我国煤矿安全规制并不是一个高质量的规制体系，解释煤矿安全规制效果的方差分解平均贡献度较小。煤矿安全规制客体的安全事故防御能力与煤矿安全规制效果存在很大相关关系，并影响煤矿安全规制效果。在利用上述计量检验结果的基础上提出建立高质量的煤矿安全规制体系、提高煤矿安全事故防御能力、合理调整煤炭产量、构建基于激励相容的煤矿安全规制体系，以改善中国煤矿安全规制效果的若干政策建议。
The coalmine safety regulation is the rules in law, technique, organize system and education for coal workers" health and safety in the working by the government. It belongs for workplace safety regulation in society regulation, the same to the economic regulation; it is the father to the market failure. In recent years, along with the coal mine heavy, especial big accidents happened continuously, the research of coal mine security regulation is more and more attached importance by the researcher. The aim of coal mine safety regulation is"depress the date rates, promote the workplace safety ",but facing the continuous big accidents, we will suspicion the availability of coal mine regulation. In the process of safety regulation, it is impacted by the level of regulation, employment, earnings, and educations, besides, it endogen sis the risk of company and brings Peltzman effect .That is to say the increase of regulation in workplace, the degrade of consciousness in defending risk, so it brings the increase the mortality rate. From this analysis, what is the effect, the influence to the coal mine safety regulation and the regulation polices, all of these are value to research, and it is the complementarities to the coal mine security regulation in China. In this paper, it researched the effect of coalmine safety regulation, based on the VAR methods, adopted the numbers from1978 to 2005.It proved that the coal mine safety regulation in China is not a high quality regulation system by analyzing dynamic connect in the regulation practice and the effect, because the contribute of variance decomposition is very small. Between the ability of defending risk in object of coal mine regulation and the coal mine regulation has an intensity connect, this connect influence the purpose of coal mine security regulation. The research proposed some suggestions to improve the effect of coal mine safety regulation by building high quality coal mine safety regulation system, enhancing the ability of defending risk, adjusting the coal quantity in reason, designing the coal mine safety regulation system from the view of inspirit consistent system, based on the result of demonstration analysis.
