本文主要围绕如何建立行之有效的惩罚性损害赔偿制度来解决我国产品市场中日益严重的假冒伪劣现状而展开论述。在本文之前，已有许多的专家、学者对解决该问题提出了自己的建议和对策，但主流的观点主要偏重于宏观调控手段的运用方面，即偏重于政府的监督管理职能。而本文试图另辟蹊径，从微观的角度出发认为：与生产经营者一一对应，并水乳交融的消费者对产品市场的广泛而深刻的社会监督，才是解决假冒伪劣现象严重的现状的最为有效且最为持久的途径。然而在现代社会，消费者自身的特点决定了其难以抗衡物力、财力强大的商家。因此必须有足够的经济利益驱动，才能刺激消费者积极地参与到与国家、社会乃至企业长远利益攸关的打假治假活动中来，为此，有必要在产品责任法中建立与我国国情相适应，并具操作性的惩罚性损害赔偿制度。
This dissertation focuses on the increasing and serious false commodity phenomenon in China and how to dead with it by theory and methodology of punitive damages system. Although many experts and scholars have brought forward their solutions to the problem before this dissertation, their points partly emphasized on making use of macroscopic regulating measures and the role of government. This dissertation tends to solve this problem in an other way of society supervision and holds this idea that the extensive but deep society supervision of consumer"s corresponding to producers and sellers is the valid and last way to solve that problem. But in the modern society, consumers limited by their characteristics can"t match with the traders who have enough resources , financial power, so only enough economic benefits can stimulate the consumer progressively to take part in the activity against the false commodity producing which is bad for our nation, society and business enterprise . For this, it is necessary to establish the operatable punitive damages system in the field of product liability law, which should be suitable for our national conditions.
