近年来,欧盟作为世界最大的区域经济合作组织,它成功的做法和经验,正日益引起国际社会的普遍关注。对欧盟政府采购合同授予制度的研究,必将为我国在对欧盟法的研究方面起到应有的作用。同时,它对于在入世时承诺于2020年将放开政府采购市场的我国,必将具有重大的理论和现实意义。 对欧盟政府采购合同授予制度的探析,本文是从其合同授予方式设计的经济分析及合同授予方式设计的法律基础入手,并对合同授予程序、合同授予标准、权益受损的救济机制等方面进行研究,提出完善我国政府采购法制的建议,以期丰富、完善我国的政府采购法律制度。 论文的主要内容如下: 第一章,欧盟政府采购合同授予法制体系构成。主要介绍欧盟政府采购指令的四个组成部分。 第二章,欧盟政府采购合同授予的方式。主要是从合同授予方式的法经济学的角度进行分析,介绍了政府采购方式设计的法律基础以及合同授予各种方式及其特征。 第三章,欧盟政府采购合同授予的程序。主要介绍和论述了程序各环节:采购信息的公告、提出投标申请以及接受投标的时限规定、对供应商、承包商或服务提供者质量的选择、对竞争者(候选人)和评判委员会的选择以及评判委员会的组成及其决定。 第四章,欧盟政府采购合同授予的标准。主要介绍和论述了“物有所值”原则的产生以及它是如何样演变为合同授予标准的理论依据,并且,还对合同授予的核心标准“最具经济优势和出价最低”原则进行了详细的论述。 第五章,欧盟政府采购合同授予权益受损救济机制。主要介绍了欧盟的两个救济指令以及两条重要的救济途径——行政救济和司法救济。在此基础上,阐释了欧盟政府采购合同授予权益受损救济机制
European Union,as the biggest regional Economic Cooperation Organization in the world, its successful method and experience in recent years has arouse the attention from various countries in academic and practice circle day by day.The study on the award of contract in EU"s government procurement, it will play an important role in the study of our country on the European Union law. Meanwhile, it will have a significant and realistic meaning in China, which has promised to open the market of government procurement when its entering into the WTO.About the analysis on the system of the award of the contract in European Union"s government procurement, this article is started from the economic analysis and the legal foundation of the award of the contract, having carried on research on the procedure of the award of contract, the standard of the award of the contract, the relief mechanism of the rights and interests etc., and putting forward the suggestion of perfecting the legal system of government procurement in our country, expecting to enrich and consummate the legal system of government procurement in our country. This content of this article is as follows:Chapter one, the composition of the legal system in European Union government procurement.
