在经济大发展,城市大繁荣的背景下,在现有的二元户籍结构下,我国流动人口尤其是流入大中城市的人口,有着经济驱动为主、青壮年为主、增长迅速、平均文化水平低等特点,这个特殊的群体在为城市建设做出巨大贡献的同时,也带来了城市管理、社会治安等诸多问题,如何做到有序、合理流动,兴利除弊,是当前政府和社会都十分关心又非常迫切的问题。作为流动人口管理的主力军,公安机关一直在综合治理中发挥着重要作用,在开展户口登记、加强治安管理、打击违法犯罪上取得了一定的成果。但当前流动人口管理法律、法规体系在民主的进程中不断完善,社会环境、治安环境也在变化中发展,公安机关的执法环境、执法依据、执法手段也必须随之而变化,公安执法工作面临着新的问题和挑战。 本文尝试从流动人口管理中公安执法的角度,以笔者所在嘉定区的公安管理实践为基础,分析当前的流动人口管理的法律环境、治安环境和社会环境,探讨公安机关在流动人口管理过程中发挥的作用、取得的成绩、遇到的问题,并着重从开展信息登记、控制违法犯罪两个角度讨论公安执法的难点和发展方向,对流动人口治安管理提出个人的设想和建议,以求在公安执法的变革中探索流动人口治安管理的正确方向。
In economic development, urban prosperity in the context of the existing dual structure of the household registration, China"s floating population especially the inflow of large and medium cities of the population, with the main economic driver, mainly young adults, the rapid growth of the average and low level of education. This special group of people in the building to make a great contribution to the city, but it also brought urban management, social security and many other issues, how to achieve an orderly, rational flow of all media, the government and society is very concerned and very pressing issue.The management of floating population as the main force, the public security organs in the comprehensive management has been playing an important role in carrying out your registered, strengthen security management, and cracking down on crime and achieved certain results.However, the current management of the floating population of laws and regulations in a democratic system in the process of continuous improvement, the social environment, changes in the security environment is the development, the public security organs of the law enforcement environment, based on law enforcement, law enforcement methods must also change, law enforcement faced with a new problem and challenges. This paper attempts from the management of the floating population in the law enforcement perspective, to the author of the Jiading District Public Security Management Practice as the foundation, the analysis of the current management of floating population in the legal environment, law and order and social environment, discussing on the public security organs in the management of the floating population the role of the achievements, problems encountered, and focus on developing information from the registration, control both illegal and criminal law enforcement perspective of the difficulties and direction of the development of the floating population to personal security management ideas and proposals with a view to the public changes in the law enforcement explore floating population of public security management in the correct direction.
