我国正处于经济转型的关键时期,作为一个重要的课题,公用事业的规制改革已经被提上了议事日程。加快公用事业的规制改革,既是完善社会主义市场经济体制的重要内容,也是加入WTO后我国经济适应全球化发展的客观要求。价格规制是规制改革中的重要部分,文章就是围绕公用事业规制中的核心问题—价格规制问题,从自然垄断的新趋势和法学理论研究相结合的角度对公用事业价格法律规制进行了深入而系统的分析研究。为了更加直观、形象地表述相关的抽象理论,文章创新地设计了大量的图表,这与通常的法学论文有很大不同。 文章首先界定了公用事业和价格规制的概念,理清了研究的范畴。从公用事业的基本理论入手,着重分析它的自然垄断性。随着经济和科学技术的发展,自然垄断行业内部逐渐发生了分化,它被区分为两个部分:垄断性环节和竞争性环节。同时,对于规制从经济学和法学的角度进行剖析,尤其在法学层面上对于规制进行了解构。其次,文章用归纳的方法从“应然”的角度构建了公用事业价格法律规制的一般理论。从对价格规制和法律的联系点出发,总结出了价格机制的五个因素:价格的法律规制目标,原则,定价主体,定价形式,制衡机制。最后,回到了“实然”的层面,采用实证的分析方法得出了我国现行公用事业价格规制过程中存在的缺陷。同时,通过对我国相关立法现状的研究,对比发达国家先进的法律规制经验,提出了从立法体系和制衡机制等方面的改革来完善我国的公用事业价格法律规制制度。 公用事业价格的法律规制不是一个独立的工程,其相关问题的妥善解决不仅需要政府的有效规制,更需要公民积极的参与,只有通过政府和民间力量的相互博弈和牵制,才能在公平和效率价值之间达成衡平,才能保障经济制度的有效执行,中国的法治进程才能顺利推进。
China is on the crucial time on the economy in transition, and in accordance with it, the regulation reform of public utilities, as an important subject, comes to the agenda. Therefore, to speed up the regulation reform of the natural industry is not only the important theme to perfect the socialism market economy, and also it is the objective request to subject to the economy globalization after China’s joining WTO. Price regulation is an important part of regulations on public utilities. The dissertation is about the legal regulation on natural monopoly price, which is the core question of the public utilities. From two aspects, the new change of natural monopoly and legal theory, the dissertation did a deep analyze and research on public utilities price. The obvious difference from other dissertations is that there are plenty of graphs and tables. That is a new idea. First, the dissertation discussed some basic concepts about public utilities and price regulation. It was very helpful to understand the next chapters clearly. Moreover, the natural monopoly was stressed. With the development of economy and technology, the natural monopoly industry had changed and it can be divided into two parts: the monopoly part and the competition part. Meanwhile, the regulation was analyzed from the two points of view. One is economics, the other is law. Second, from the perspective of reality the theory about legal regulation on public utilities price was constructed by inductive inference. In the dissertation the price regulation was connected with the relevant law, it took shape five key points about legal regulation on price: objective, principle, subject, pricing method, balance mechanism. At last, the dissertation began to focus on the reality. From the experience of china, it pointed out that in china there are many presented legal antidotes on those questions. By studying the successful experience of the western courtiers and correctly analyzing the problems of our country, it suggested that China should improve the relevant legislation, at the same time the balance mechanism need to be strengthened. In my concern, the public utilities price is a systematic project. On one hand, the government should take effective measures. On the other hand, the citizens should participate in the management positively. Only under the help of law regulation and the mutual restriction between the government and the folk force, the public utilities keep its balance between fair and efficiency, and the economy in China can developed smoothly. And the law construction can developed quickly only under a perfect economic surrounding.
