传统的离婚道德注重婚姻的义务,强调婚姻的社会性和稳定性,却压抑了当事人的个人自由,忽视了当事人的感情。追求自由和平等的现代人更注重婚姻中的感情,强调婚姻的质量,他们自由出入婚姻的城堡,却往往漠视婚姻的社会责任。那么如何在实现离婚自由的同时,又不造成社会责任的缺失呢? 恩格斯早已指明:实现完全的婚姻自主和离婚自由不仅要以经济作为后盾,而且要以高度的道德责任感作为文化基奠。认为“道德制约离婚自由”的观点是站不住脚的,笼统反对离婚自由或赞同离婚自由都是缺乏理性的。我们反对婚姻的不可离异性,但不是鼓励离婚;我们提倡离婚自由,但不是纵容草率地和不负责任地离婚。怎样在离婚的个人自由和社会责任这场博弈中找到平衡,即实现自由和责任的“双赢”,这就需要我们立足当前社会现实,紧跟时代步伐,在继承优良道德传统的基础上,以宽容、平等、人道为核心构建新时期的离婚伦理。
Traditional marriage morality cares more about the social features and stability of a marriage than about the letigants freedom and feelings. In modern times, people pay more attention to the feelings in marriage and the marital quality, but often ignore the social responsibility of marriage. it is obviously unfair and out of date to put much emphasis upon only one aspest.But how to achieve the freedom of divorce, and not make the lack of responsibility? Engels has pointed out for us that people want to achieve divorce freedom ,this not only depended on social economic development ,but also needed a high sense of moral responsibility . The viewpoint thinking that“moral constraints divorce freedom”is untenable .Any unreasonable pros and cons to personal divorces are mistaken,and free divorces are not equal to careless and unresponsible divorces. In order to gain personal freedom and shoulder moral responsibilities,modern persons ought to be conducted by new concepts of matrimony,based on equality,tolerance and humanity,which are developed from both modern and traditional moral virtues.
