在行政伦理领域,制度伦理与个人伦理是行政伦理道德建设的两个基本纬度。在现代公共行政理论中,法律和制度建设倍受重视。因为没有完善有力的法律和制度,就不可能对行政权力进行有效的制约。然而,个人行政伦理却被忽视或边缘化了。于是,一边是日趋精密的法律和制度的建设,一边是日益攀升的行政人的伦理道德失范和不断扩大的行政腐败规模。事实上,制度伦理与个人伦理关系密切,即如果个人伦理建设薄弱,道德良知匮乏,那么法律、制度就不可能对个人形成有效地影响和约束。所以在法制逐步健全的今天,我们在完善法律、制度建设的同时,公共行政的出路必须诉诸于被“现代”边缘化的个人伦理、德性的价值关怀。在强调法律责任、岗位责任等这些消极责任的同时,更要贯彻积极的行政伦理责任。只有行政人践行行政伦理责任,才能更好地履行法律责任和岗位责任,提高公共行政能力,也才能在行政伦理困境中做出正确的价值选择,才能遏制行政腐败的蔓延。 本文综合运用哲学、伦理学、行政学、教育学等多学科的相关知识及研究成果,采用历史的方法、逻辑的方法、理论联系实际的方法,从行政伦理与行政管理相结合的角度,基于行政伦理责任不同于法律责任和岗位责任的特点,对行政人伦理责任的含义及其在解决伦理困境中的作用、行政伦理责任的实现途径等问题作了有益的探索。 本文共分为四部分。第一部分“行政人的含义”,批判地梳理了行政学理论中的行政人概念,指出只有行政伦理学中的“行政人”赋予了行政人以伦理主体性,本文的“行政人”即行政伦理学中的公共行政人员。第二部分探讨了“行政人的伦理责任”。行政人是公共权力的行使者,有权必有责。在这一部分中,系统论述了行政伦理责任的含义、行政伦理责任与其它行政责任的关系,确立了承担行政伦理责任的前提——自由与责任的统一,提出行政伦理责任的价值基础——公正。第三部分“行政人的伦理困境及其价值选择”,论述了行政伦理责任是解决行政伦理困境的关键,行政人践行行政伦理责任的重大意义。第四部分“公共行政伦理责任的实现途径”,笔者根据科尔伯格的个体道德发展理论,从五个方面进行了论述。包括:“在法律体系中渗透行政伦理责任的基本理念”、
In the area of administrative ethics, system ethics and the personal ethics are two basic latitudes of the construction of administrative ethics. In the theory of modern public administration, the construction of law and system are paid more attention. Because of no perfect and powerful law and system, there is on possibility to control the administrative power efficiently. However, the personal administrative ethics is overlooked or marginalized. Therefore, on one hand, the construction of the law system becomes more and more precise. On the other hand, the scale of the odd morality and administrative corruption is becoming more and more serious. In fact, the ethics is closely related to personal ethics. If the construction of personal ethics is very weak and the individual moral conscience is scarce, law and system will not effect and restrain individual efficiently. Today, legal system is sound progressively, public administrative outlet must appeal to on "modern" individual ethics of marginalization, the value of the moral character shows loving care.When we stress on the negative responsibilities such as administrative responsibility, post responsibility and so on, we should carry out the positive ethics responsibility. When the administrator only practice administrative ethics responsibility, he can perform his low responsibility and post responsibility, improve the ability of public administration, and do right value decisions in the ethical dilemma and prevent the administrative corruption.Using related theories and thought from philosophy, ethics, the administration studying, pedagogics, etc., adopting the method of history, logics, combination of theory and practice, the thesis that was based on the features of administrative ethics responsibility distinguished from law responsibility and position responsibility beneficially probed into public administrator"s ethics responsibility, the role of resoluting ethical dilemma and the realization of administrative ethics responsibility from the connection of administration ethics and the administrative management point of view.This thesis consists of four chapters. The first chapter "the meaning of administrative", critically established the concept of administrator in the theory of administration studying.
