论文标题:罪刑法定原则研究 A Study on the Principle of a Legally Prescribed Punishment for a Specified Crime 论文作者 刘霜 论文导师 郝守才,论文学位 硕士,论文专业 刑法学 论文单位 河南大学,点击次数 248,论文页数 66页File Size232k 2003-05-01论文网 http://www.lw23.com/lunwen_35328552/ 罪刑法定原则;价值蕴涵;明确性原则;类推 A legally prescribed punishment for a specified crime;Value of the principle;Explicit definition;Analogy 罪刑法定原则是刑法理论及刑法实践中带有全局性和根本性的问题,已经被大多数国家和地区的刑法确定为基本原则。我国刑法理论界及司法界也曾针对罪刑法定原则能否作为刑法的基本原则展开过激烈的讨论,最终在1997年修订的《刑法》中明文规定罪刑法定,并将其作为刑法的首要的基本原则。罪刑法定原则虽已经在刑事立法上得以明确,但还未在我国得到很好的贯彻与实施,刑事立法与刑事司法等方面还有很多不尽如人意的地方。因此,针对罪刑法定原则,很有必要进行一番深入的探讨。这也是本文选题的意义之所在。全文共分为七个部分,约五万余字。第一部分,罪刑法定原则的历史沿革。该部分从罪刑法定原则的早期思想渊源,到启蒙思想家的初步论述,再到大陆法系、英美法系及中国、前苏联等国家刑法的规定,对罪行法定原则的历史沿革过程进行了系统的阐述,引出了本文的论题。第二部分,罪刑法定原则的理论基础。该部分阐述了大陆法系国家传统的罪刑法定原则的理论基础为三权分立理论和心理强制理论。但三权分立理论和心理强制理论已经不适应现今的实际情况,只具有沿革上的意义。现代意义的罪刑法定原则的理论基础为民主主义和保障人权。而在我国,罪刑法定原则的理论基础是社会主义法制的必然要求。第三部分,罪刑法定原则的价值蕴涵。该部分由古典学派的个人本位的罪刑法定原则到近代学派社会本位的罪刑法定原则;由绝对的罪刑法定原则发展到相对的罪刑法定原则,对罪刑法定原则的价值蕴涵进行了论述。罪刑法定原则倾向于保障人权,但也可兼顾社会保护机能,由此体现刑法的公正与谦抑性的价值。第四部分,罪刑法定原则的基本内容。该部分首先论述了绝对罪刑法定原则的基本内容。由于绝对罪刑法定原则的缺陷显而易见,已被大多数国家所弃用。目前大多数国家都采用相对罪刑法定原则,文章即而介绍了相对罪刑法定原则的基本含义以及相应的派生原则。第五部分,罪刑法定原则的立法体现及司法适用。该部分对罪刑法定原则的立法体现、司法适用展开了论述:在立法体现方面,分别论述了大陆法系、英美法系国家及中国的罪刑法定原则的立法体现;在司法适用方面,分别从司法认定、司法解释、司法裁量等方面进行论述。第六部分,罪刑法定原则与类推制度的存废之争。对于类推制度,有永久保留说、暂时保留说、立即废止说的争论。该部分介绍了这三种观点,并提出自己的观点,赞同立即废止说,主张在刑法中应废止类推制度,明确规定罪刑法定原则。并提出五点理由进行论证。第七部分,罪刑法定原则在刑事立法与刑事司法中的缺陷及其弥补,并对缺陷产生的原因进行深层次的反思。该部分首先阐述了罪行法定原则在刑事立法中的缺陷,例如罪刑设置不完整、确定性原则贯彻不足、立法合理性原则贯彻之不足等等。其次,在刑事司法方面存在司法解释侵入立法领域、解释主体的合法性不明确、对于被告人权益的漠视等等缺陷,并提出相应的处理方法。最后,探求我国罪刑法定原则刑事立法与刑事司法缺憾产生的深层次原因,主要从立法的有限性与司法的独立性来分析。 The principle of a legally prescribed punishment for a specified crime is the fundamental issue in the criminal theory and practice. Many countries and regions establish it as the fundamental principle of the criminal law. It is one of the very important and basic principle of the criminal law. This article states the aspects and effects of the principle of a legally prescribed punishment for a specified crime. But there are some defects in practice and implement. We have to make a thorough inquiry of this principle. This article, about fifty thousands of words, consists of seven parts. Part one. This part introduces the historical evolution of the principle of a legally prescribed punishment for a specified crime. And this part sets forth the ideological origin, the theory of thinkers in the Enlighten, the regulations in the countries of the continental law system or Anglo-American law system and also in Soviet or in China. Part two. This part clarifies the theoretical basis of the principle of a legally prescribed punishment for a specified crime. It demonstrates that the system of the separation of powers, the theory of mental coercion, the democratic doctrine and defending the human rights. In China, the principle of legality is the theoretical basis of the principle of a legally prescribed punishment for a specified crime. Part three. This part states the value of the principle of a legally prescribed punishment for a specified crime. From the absolute principle to the relative principle, from the classical criminal laws school to the moderncriminal laws school, the value of the principle of a legally prescribed punishment for a specified crime intends to fair and modest. This part demonstrates the relationship between the analogy and the principle of a legally prescribed punishment for a specified crime. There are three viewpoints, such as the retention of analogy for life, transient retention of analogy and the abolition of analogy. This article agrees the last viewpoint. Part seven. This part points out the defects and the amendments of the principle of a legally prescribed punishment for a specified crime. There are some defects in the criminal legislation and criminal jurisdiction. This part demonstrates two reasons such as the limit of criminal legislation and the independence of jurisdiction.
