森林是人类生存和发展的基础,是地球上功能最完善、结构最复杂、产量最大的生物库、基因库、碳储存库和绿色水库,是维护陆地生态平衡的重要调节器。其在维护生物多样性和国家生态安全方面发挥着重要的作用。尤其对于像我国这样一个森林资源分布不均、结构不合理、人均相对贫乏的发展中国家,更显得十分重要。如何遏制我国森林资源恶化的趋势以及如何实现森林资源的可持续发展,已成为当务之急。森林法是国家对森林资源进行保护、对林业生态环境和森林资源进行合理利用、进行宏观调控的法律途径。我国以《中华人民共和国森林法》为主的森林法体系经过多年的建设已经初具规模,对森林资源的经营和保护、发挥森林资源的生态作用都发挥着积极作用。但是随着市场经济体制的进一步完善和生态建设进程的不断加快,现行森林法不能完全适应社会发展的客观需要。正如国家林业局政策法规司所指出的:“当前,中国林业正处在由以木材生产为主向以生态建设为主的历史性转变时期,尤其是2003年6月《中共中央国务院关于加快林业发展的决定》发布后,林业新情况、新问题不断出现,深化林业体制改革,增强林业活力,调整和理顺生产关系等已经成为进一步发展林业的客观需要,所有这些都迫切需要用法律予以规范。因此,亟需对森林法进行修改和完善。”“他山之石,可以攻玉”,在修改和完善森林法时通过借鉴其他国家的先进理论和汲取他国的经验教训再结合我国的具体情况无疑可以让我们少走弯路。本文通过对中国和俄罗斯的森林资源法律制度进行比较,从中找出值得我国吸收借鉴之处,旨在能对我国森林法的修改和完善有所启示。
The forest, as the foundations of human survival and development, which has the most perfect function, the most complicated structure and the heaviest output, is a biological bank, a gene bank, a carbon storehouse and green reservoir. It is the important regulator which maintains the land ecological balance and plays an essential role in maintaining biodiversity and national ecological security. Especially in China, misdistribution, unreasonable structure, low occupancy per capita, so forest resource seems more important. It has been a task of top priority that what to do for preventing the worsening trend of forest resource and how to realize the sustainable development of forest resource. Forest law is a legal way which protects the forest resource, adjusts forestry ecological environment in macro means and utilizes forest resource properly. The system of forest law relying mainly on forest law of the People"s Republic of China of our country through the construction for many years has played a positive part in management and protection of forest resource, promoting the ecological function of the forest resource. Just as State Forestry Bureau Policy and Regulations Department pointed out: "At present, the Chinese forestry is in the historical transitional period from relying mainly on producing timber to relying mainly on ecological construction of forestry, especially after June 2003, the decision of speeding up the development of forestry was promulgated by Central Committee of the Communist Party of China the State Council, forestry"s new situation, new problem are appearing constantly, deepen forestry"s system reform, strengthening forestry"s vigor, adjusting and making relations of production ,etc, has already become desirability that has developed forestry further, all these need to give the norm with the law urgently. So, we need revising and perfecting the forest law badly." "Stones from other hills can attack the jade ", while revising and perfecting the forest law through use other advanced theory of country for reference and draw experience and lessons of other country combine concrete conditions of our country can let us to be little undoubtedly walk in the detour. According to the comparison of the legal system of Sino-Russia forest resource, the thesis finds out something we can absorb and some lessons we can draw from which is the enlightenment to modification and perfection of the forest law of our country.
