环境问题虽然由来已久，但作为一个问题的提出还是在上世纪五、六十年代。对环境保护问题的研究，主要集中在从经济学的角度、伦理学的角度研究环境保护问题。从经济学的角度看，有环境资源说、环境经济说、制度经济说。从伦理学的角度看，有人类中心主义、非人类中心主义、可持续发展环境伦理说。但从各种有关资料看，从制度的角度特别是从社会制度建构的角度对环境保护进行研究还是很少。尤其从社会制度建设综合的角度研究环境保护更少。所以，本论文的研究从社会制度建设综合的角度，研究为保护环境而建构的社会制度所应遵循的原则，对于环境保护社会制度的建构提供了极有参考意义的建议，对于从制度上解决环境保护问题具有创新价值。 本文导言部分，简要回顾了从经济的角度、伦理的角度研究环境保护问题的具体内容和不同学派。本文第一章从环境问题和社会制度的关系展开。说明环境问题其实就是一个制度问题，是规范人类社会的思维方式、社会的行为习惯、以及人类经济活动的各种层次的制度的治理问题。认为目前环境问题的解决应主要围绕着人类社会制度的重建为中心展开，而建立环境友好的、保证人与自然和谐发展的各种社会制度是环境保护的出发点与归属。第二章提出了环境友好制度的建构要遵循历史的原则、“以人为本”的原则、体现发展的原则、体现系统性的原则。第三章、第四章、第五章分别论述了环境保护制度的意义建构、合法性建构、资源体系的构建模式、特点、规律、要求等。第六章从经济学的角度研究对环境保护的制度安排，提出建立相当明晰的环境资源产权制度是环境保护的内在要求。第七章根据前面几章的分析，提出环境保护制度建构的对策建议。一是建构环境自治的社会。包括建设“以人为本”的环境体系、建设“环境自治”的公民自我教育机制、规范“环境自治”的民主社会制度建设。二是完善环境资源市场。包括优化环境资源市场环境、创新环境资源市场管理手段、加强对环境保护的经济投入。
Though the environmental problem has been a long-standing one, it did not become a focus of attention until 1950s or 1960s. The problem was mainly addressed from the point of economics and ethics. The point of economics includes environmental resources study, environmental economics study and system economics study. The point of ethics includes anthropocentric, non-anthropocentric and sustainable development environmental ethics study. However, all the related documents indicate that the issue of environmental protection has been less addressed from the point of system construction, in particular the social system construction. Therefore, the present thesis, from the comprehensive perspective of building social system, researches the principles being followed when constructs social system for the purpose of protecting environment. This research offers meaningful references for the construction of environmental protection social system. It is of innovative value for the solution of environmental problems through system construction. The Introduction briefly recalls the detailed contents and varieties of schools of addressing environmental problem from the perspectives of economics and ethics. Beginning from the relationship between environmental problem and social system, the first chapter illustrates that environmental problem is actually a system problem. This system is to rectify human being"s thinking mode, social behavior and economic activities. The present author holds that the solution of environmental problem should depend on the reconstruction of human being"s social system. Thus, building an environment-friendly society of harmonious development between man and nature is either the starting point or the attaching point. The second chapter puts forward that the construction of environment-friendly society should follow such principles as history, humanism, development and system. The third, fourth and fifth chapters respectively discuss significance construction and legitimacy construction of environmental protection system, and the mode, characteristics, law and requirement of resources system construction. The sixth chapter researches the system arrangement of environmental protection, and gives the idea that building a clear environmental resource ownership system is the inherent requirement of environmental protection. The seventh chapter suggests two countermeasures of environmental protection. One is to construct an environmental autonomy society, which includes establishing a "humanism" environment system, forming an "environmental autonomy system" characterized by citizen"s self-education and regulating the democratic social system construction for the "environmental autonomy". The other is to improve the environmental resource market, which includes optimizing market performance, innovating the management of environmental resource and increasing the investment to the environmental protection.
