本文在研究目前国内海上人身伤亡相关法律法规的基础上，对国内外海上人身伤亡的赔偿办法进行了比较分析。研究的目的在于适应我国法律法规不断完善的新形势，使海上人身伤亡损害赔偿的法律规定与各相关法律规定接轨，与我国加入WTO后的新形势接轨；并根据我国的国情，探求一种科学合理的海上人身伤亡损害赔偿办法，尽可能地找到一个海上运输业和受害者两者利益间的平衡点，使海上运输业和受害者的合法权利得到更加充分的保护；进一步研究海上人身伤亡损害赔偿的法律理论基础，为进一步修改我国海上人身伤亡损害赔偿的有关法律提供依据。 全文共分6章，内容主要是海上人身伤亡的损害赔偿范围和责任限额。其中： 第1章为绪论 第2章为海上人身伤亡损害赔偿与责任限制的一般理论问题研究。主要探讨了海上人身伤亡的含义、赔偿范围的界定、责任限制等问题； 第3章为我国海上人身伤亡损害赔偿范围的研究。着重对国内和涉外海上人身伤亡损害的赔偿范围进行了分析和比较，找出了存在的问题； 第4章为我国海上人身伤亡责任限制的研究。着重对旅客和旅客以外的人员伤亡损害的责任限制进行了分别分析，找出了存在的问题及解决办法； 第5章为我国海上人身伤亡损害赔偿存在的主要问题研究。涉及关于责任限制的修改以及船员、旅客以外的受害人单个责任限制等问题； 第6章为立法建议。主要对进一步建立和完善我国海上人身伤亡损害赔偿法律制度提出若干建议。
This paper is in essence a comparative study of the different ways of compensation in China and abroad for casualties at sea. It aims to bring up to date China"s laws and regulations of compensation for casualties at sea, so that they would better fit in with the fast-changing social, economical and legal situations in China after its accession to the World Trade Organization .It attempts to seek out, to be specific, a way of compensation as sound as possible which would maximally protect the legitimate rights of both the owners of vessels and the victims, hopefully by satisfactorily balancing the interests of the two parties. The ultimate purpose of this paper therefore, is to provide certain theoretical support for modifying relevant laws and regulations in this realm in China.The two key issues addressed in this paper are firstly the coverage of compensation for casualties at sea and secondly the limits of the owner"s liabilities. They are dealt with step by step in six chapters.Chapter one is preface.Chapter two takes a look at the relevant theoretical knowledge, including the definition of casualties at sea, and how to define the limits of both the coverage of compensation and owner"s liabilities.Chapter three compares and contrasts the domestic, and the international coverage of compensation for casualties at sea. Current problems and their causes are also discussed.Chapter four is a comparative study of the domestic limits of owner"s liabilities and the international ones. Current problems and their causes are again pointed out.Chapter five follows by a summary of the major problems currently exist in the area under discussion. Highlighted are these issues: how to decide upon one of the two sets of laws applicable, penalty compensation, modification of the limits of liabilities, and the limits of liabilities for individual victims other than passengers.Chapter six concludes this paper with numbers of suggestions for improving China"s laws and regulations in the area being investigated.
