随着我国对外贸易和科技文化交往的飞速发展，海关作为通关监督管理机关，职能不断扩张，拥有越来越多的自由裁量权。如何正确认识通关之行政自由裁量权，对其实施有效控制，防止其被滥用，对海关依法行政，推进通关法治化进程具有重要意义。 本文首先为论述通关之自由裁量权作了一个理论支撑。从现代海关通关的起源与发展出发，分析海关通关的性质与任务。从海关权力出发，分析行政自由裁量权的含义，从而对通关之行政自由裁量权进行界定，并指出其特点。 在上述理论阐析的基础上，系统研究通关之行政自由裁量权的存在基础和产生领域，并以上海浦江海关的通关实践来说明其运行。以法律规定和实践相结合，研究通关之行政自由裁量权滥用的表现和风险。文章通过四个具体案例指出通关之自由裁量权滥用的原因，即立法缺陷、司法不足、程序违反和行政失衡。 最后，文章从海关通关实践出发，认为对海关通关之行政自由裁量权滥用的控制是一个系统工程，必须从不断完善立法、司法、程序、行政控制入手，多管齐下，综合治理，构筑对通关之行政自由裁量权监控的综合网络，才能对其滥用实施有效的监控。
With the development of foreign trade and science and culture, as supervision of clearance, the function of customs continuously dilated. It owns more and more administration discretion. It is very important for ruling by law to have a correct understanding of administration discretion in clearance, to control its abuse effectively.Firstly, there is a foundation of the demonstration of the discretion. Through deep analysis of the origins and development of modern customs, the paper studies the natures and tasks of clearance. From the authority of the customs and the meaning of administration discretion, the paper defines the implication and feature of administration discretion in clearance.Based problem on the above theoretical describe and analysis, the paper studies existing base and emerging field of administration discretion in clearance, clarities its operation by the example of Shanghai Pujiang Custom. Combing law with practice, the paper discusses the performance of its abuse and risks. The paper points out the reasons of its abuse by using four examples.Finally, the paper gives some advice of its control from the practice. It is a systems engineering to control the abuse of administration discretion in clearance. We must build network synthesis of control through legislative, judicial, procedure , administrative to control the abuse of administration discretion in clearance effectively.
