文章分六个部分对中国涉外民事司法协助程序改革问题进行了研究。第一部分从国际民事司法协助的现状与发展趋势谈起，对当前国际民事司法协助的现状，包括国际民事司法协助中国际和国内的立法体系、立法内容、形式等问题作了分析，并以此为依据，归纳阐述了国际民事司法协助具体的发展趋势。第二部分通过分析我国涉外民事司法协助的现状，研究我国涉外民事司法协助方面存在的规定过于原则，范围过窄、缺乏可操作性等一些问题。第三部分提出了我国涉外民事司法协助立法改革的总体框架，提出了制定我国《涉外民事司法协助法》的立法建议和初步的立法结构。第四部分就《涉外民事司法协助法》中文书送达部分提出了一些新的立法改革构想。第五部分对《涉外民事司法协助法》中涉外调查取证部分提出了新的立法建议。第六部分对《涉外民事司法协助法》中关于对外国法院判决和仲裁裁决的承认和执行的相关规定提出了改革的立法建议。
The article which is subdivided into six chapters discusses and makes research on the issuses of the reform of the civil judicatory assistant Procedure in China . The starting from the present conditions and the developing tendency of the International civil judicatory assistance, the international and native legislative system in the international civil judicatory assistance, the legislative content and form. According to that, focus on the developing tendency of the international civil judicatory assistance. The second chaper analyzes the present conditions of the civil judicatory assistance in China, researches on some problems, the stipulations are too much principled, the scope is too much narrow and unoperational ,for example. The chaper three puts forward the totality frame of the reform of the civil judicatory assistant procedure in China and some new suggestions. The fourth chapter puts forward new proposition about delivering legal papers in new <> The chaper five puts forward new legal suggestions about investigating in <> The sixth chaper puts forward some new suggestions about admiting and executing the adjudicate of foreign court.
