著作权的权利限制随着著作权制度的问世而产生。网络传播权是著作权在网络中最重要的权利之一,是著作权人的权利在网络环境中的延伸和扩张。网络技术的发展给著作权限制带来了前所未有的挑战,对网络传播权限制的研究成为著作权领域的重要内容,也是著作权领域讨论的热点和难点问题。 网络传播权作为网络著作权的主要内容,是法律赋予著作权人控制自己的作品在网络上传播的专有权利,与网络文化的自由与开放精神相冲突。在保障著作权权利人合法权利和商业回报的前提下,社会公众要能最广泛地使用人类的智力成果,实现最大可能的资源共享,就必须对网络传播权进行合理限制。这既符合著作权正义性价值理念的要求,也是减缓平等和效率的冲突的需要、著作权本身反垄断的需要以及资源优化配置、实现和维护国家的社会经济利益的需要,同时这还将使获取信息和受教育的机会增多,并同样可以使权利人获得利益,推动社会的进步。 对网络传播权的限制应当遵循一定的原则,主要有四:一是效率与公平的平衡统一原则;二是“三步检验标准”;三是诚实信用原则;四是公序良俗原则。 网络传播权限制的核心内容是“合理使用”,反映在国际、国内立法规定上,有共同性也有特殊性。“默示许可”是否应视为对网络传播权的合理使用?技术保护措施和网络合同的出现对合理使用空间的大大挤压等成为网络时代合理使用面临的难题。鉴于网络技术的日新月异和规则主义立法的局限,应当对网络传播权的合理使用作出开放性的规定。同时网络时代合理使用出现新发展,应当适应网络传播权的特点赋予部分传统的合理使用新的内涵并适度扩大网络中合理使用的范围。
The restriction of copyright came out with the emergence of the copyright rules. Right of internet communication is one of the most important right and the expansion of copyright under the internet environment. The development of internet technology brought challenge to the restriction of copyright. The study about the restriction of right of internet communication has become the important substance and also a problem with concern and difficulty in the copyright realm.As the main part of Internet copyright and monopoly right which law gives people with copyright to control the internet communication, right of internet communication conflicted with freedom and open spirit of internet culture. Under the premise, that is, to ensure the legal right and commercial repay of people with copyright, we must restrict right of internet communication reasonably to pledge the public use of intelligent achievements most extensively and realize the share of resources most probably. That accords with the demands of justice, and also is the demands to ease up the conflict between equality and efficiency, to fight against monopolies itself and realize resources optimum deploy, realize and safeguard our country"s economic benefits. At the same time, it will bring more chances to acquire information, accept education for more people and also will bring benefits to the people with copyright, promote the development of society.To restrict right of internet communication, we must follow some principles, major of which, are the principle of balance and unity between equality and efficiency, principle of the "three steps to test", and the good faith, the principle of public order and fair practice.The key part of rules about the restriction of right of internet communication is "fair use".
