目前,我国医患关系紧张,医疗纠纷剧增,医疗损害赔偿数额巨大,探索如何分散医疗执业风险,缓解医患矛盾的良方,已经成为研究热点问题。医疗责任保险被证明能够有效分散医疗执业风险,赔偿医疗机构因医疗侵权对患者造成的损害。医疗责任保险在国外已有一百多年历史,目前国外主要发达国家均有健全完善的的医疗责任保险制度。我国从20世纪80年代末开始引进医疗责任保险制度,先后许多城市和地区进行了试点和探索。2002年国务院《医疗事故处理条例》颁布,使得医疗责任保险在医疗损害赔偿方面显得更加重要,各地掀起实施医疗责任保险的热潮。本文通过对我国医疗责任保险制度实施中存在的问题进行总结,针对性地提出相应对策,以期使我国的医疗职业保险制度更加完善,促进医疗卫生事业健康发展。本研究从四个方面进行了阐述: 第一部分:对我国医疗纠纷发生现状进行总结,对医疗损害的民事赔偿责任进行法律分析,阐述现代医疗责任保险的概念、法律特征,并分析医疗损害赔偿责任与医疗责任保险之间的联系,实施医疗责任保险制定的必要性和意义。 第三部分:对医疗责任保险的发展历史,以及在国内外的发展过程和现状进行综述。
At the present time, the relation between doctor and patient is extremely tense, the quantity of medical dispute increases quickly, the claim for compensation from patient is becoming huge. How to resolve these problems is the important research now. Medical liability insurance has being proved to be the effective method that can distract medical professional risk, and pay for medical damage from the insurance policy-holder. It has over one hundred year history, and being established in many developed countries. It was introduced to China at the end of 1980s, being experimented in many cities or regions. The proclamation of the statute on medical accident disposal in 2002 makes the medical liability insurance more important and popular in China. This research gather and analyze the problems on medical liability insurance practice in China, and give the countermeasures, in order to make this insurance perfect and promote our clinical medicine develop better.
