《中华人民共和国城市规划法》于1990年4月1日起正式实施,它是建国后我国第一部调整城市规划法律关系的法律,它的诞生标志着我国城市规划工作走上了“法治”的轨道。经过10多年来城乡建设实践的不断发展和深化以及随着市场经济体制的建立,现行的《城市规划法》在很多方面呈现出越来越多的缺陷和不足,已经难以适应当前中国经济、社会、法治等多方面的发展要求。修改《城市规划法》或制定新的《城乡规划法》的呼声日渐高涨,促使我们在对现行《城市规划法》本身和实施过程中的问题进行深层次反思的基础上提出修改和完善的建议。 本文的论述分为三部分。首先介绍了城市规划公共政策的本质属性,现行《城市规划法》的概念及适用范围,并对城市规划法律关系进行了扼要分析。 第二部分重点论述了我国现行《城市规划法》的缺陷与不足。指出《城市规划法》的宪法依据、权利配置等方面与宪法原则的冲突,在功能定位上与城市规划的混淆,《城市规划法》中的公共利益及对现有产权的忽视致使规划实施困难和社会矛盾增加,城市规划部门的自由裁量权过大而导致的各种危害,城市规划中执法难导致违法建设泛滥等几个方面的问题;并对各种问题的成因进行了深入详细的分析。 第三部分对《城市规划法》的完善提出建议,首先应确立《城市规划法》的宪法原则,重新明确《城市规划法》的功能定位,界定公共利益边界,明确公共利益与个人利益同等保护原则,限制规划部门的自由裁量权,强化执法权;其次应借鉴国外城市规划立法中的经验,设立“公众参与”程序,落实民主决策措施;第三应通过推进城市规划法制化建设来完善《城市规划法》。
< Urban Planning Act of PRO carried out since April. 1 1990. This is first set of the laws which adjust the urban construction since our country founded. This means our country has entered into the formal path Current the law shows the more shortcomings and the weak point during the developing of the urban and rural construction and the foundation of the market economy system of the past 10 years, it is the difficult to meet the more request from the Chinese economy, society and socialist legal system. As for needs for the amendment for< Urban Planning Act >and the draft the new one , we are forced to take more consideration and present the rectification and the completed suggestion based on the current < Urban Planning Act >and the problem which we encounter while < Urban Planning Act > proceed.The summary has three parts, the first part introduce the essence of urban regulation public policy, the concept of < Urban Planning Act >, working area , and the simple analysis of relationship with law on - urban planning .The second part emphasis on the defects and weak points on our current < Urban Planning Act >. We point out the conflicts among our evidence of constitution of PRC, the priviledge balance and the rules of constitution of PRC; the mixture between the function spot .the public interest of < Urban Planning Act >and the ignorance of property right caused the difficulty of execution and social contradiction speed up; the more administrative discreation the more negative effect is caused ;the difficult of executive leads to the construction-illegal being in flood; analyze the roots for the various problem .Last part relay the proposal for the < Urban Planning Act >, firstly set up the discipline, verify the location for function, flow over the frontier of public interest, ensure the protection rules between the public and the personal interest, standardize the administrative discreation, strengthen the executive priviledge. Then absorb the experience from foreign urban regulation. Working out the public participant programme, compliant the demonstrative measurement, finally completed the law on- the whole urban regulation system .
