政治合法性被普遍认为是执政的重要资源之一。从人类历史演进的过程可以看到,无论由何种方式取得的统治,统治阶级在掌权后都力图取得民众的信仰、支持和认同。如果政权能及时地取得来自人民的此种认同,则大大有助于政治秩序的稳定和统治权力的运行。政治合法性也是现代执政党关注的重要政治目标之一,构建合法性基础是执政党维护执政地位的重要途径。根据政治合法性基本原理,执政党执政合法性基础具有社会历史性,也就是说,它不是静止不变的,而是随着社会历史环境的变迁而处于不断地变化之中。执政党获得了执政的合法性,并不意味着它从此就可以一劳永逸,永久地执掌政权。纵观中国共产党五十多年来的执政的历史,对马克思主义意识形态的深信不疑和经济增长的不懈努力,成为中国共产党获得执政合法性的主要途径和基础。然而,改革开放以后,中国社会逐渐步入了由传统向现代的转型期,随着利益主体、阶层结构、分配格局等日益多元化,以及由此带来地人们思想观念、价值取向的多样化,逐步导致了执政党原生性的和传统的合法性资源的弱化和流失,多元、开放的现代性因素使得执政党传统执政资源面临着巨大的压力。与此同时,新生执政资源的产生和发生作用又需要一个过程。在这种情况下,党的执政合法性基础不可避免地面临着挑战。 从另一个角度来看,许多现代化研究表明,权威的理性化,亦即实现传统的人治型权威向现代的法理型权威的转变,是国家政治转型的根本标志。当前,我国正处于向现代化社会的转型过程之中,建设法治国家、树立法理权威是我们转型的一个重要目标。此外,中国是一个后发型现代化国家,保持适当的政治权威是实现现代化赶超战略的一个不可缺少的条件,同时,中国在实现从人治社会到法治社会的转型过程中,也需要政治权威的保障与促进作用。以中国共产党为载体的“政党权威”的确立及其政党权威合法性基础的强化恰恰符合了这种需要。 由此可见,对于处于后发现代化国家中的执政党来说,其执政合法性基础面临着强化与转型的双重任务。社会转型期执政党能否成功地构建自
Political legitimacy is generally thought to be one of the important ruling resources. From the history evolvement of mankind, we can saw, regardless obtain governance by what way, all the governmental classes strive to obtain support and advocacy of the masses after holding the dominion. If the regime can obtain the kind of approbation coming from the people duly, it can be contribute to the stability of the political order and movement of the political power. The legitimacy is one of the targets that are concerned by the modern ruling parties, and It is the basic path to preserve the position of the ruling to construct the legitimate foundations.According to the basic principles of political legitimacy, the legitimate foundations are historic and social, that is to say, they are not static, but be evolutive continuously along with the social environment changing. It doesn"t mean that the ruling party gets the ruling legitimacy done once and for ever. Take a wide view for more than 50 years ruling history of Communist Party of China, the main paths and foundations of ruling legitimacy of Communist Party of China are ideology of Marxism and economic growth. However, since the reform and open, society of China has been transforming from the traditional society to the modern society. Along with the benefit group, stratum structure, and assignment structure diversifying increasingly, the ideas and values of the people hare been diversifying. It had caused the original ruling legitimacy resources to be weaken and run off gradually. Moreover, the neonatal resources can"t immediately take effect. The base of ruling legitimacy of our party has to face the challenge.For Communist Party of China in developing country, the base of ruling legitimacy faces dual missions with enhance and transform. In the period of society transformation, whether the ruling position of the party can be stronger and to be stable long time or not, the key lies in whether the party can hold the developing law of ruling legitimacy foundation to adapt the volatile situation and support the valid legitimacy foundation that already have and draw to take and expand the lately ruling legitimacy in good time, for the end to carry out a transformation with basis legitimacy of modern legal theory to create the condition. Only high raise " three representatives" importance thought flag, enrich and develop Marxist main current ideology continuously, relieve and develop the productivity continuously, promote economic and society of harmonious development, improve the leadership of the party continuously and the ruling way, push forward the democracy to systemize and legalize, the ruling party then can acquire extensive approbation and support of the people and its base of legitimacy then can make stronger.
