律师制度是国家民主政治制度的重要组成部分，律师业的发展水平反映了一个国家法治文明程度的高低。21世纪的中国律师业面临着以信息和知识经济为基础的我国现代化的持续发展，以及加入世界贸易组织后我国进一步开放和市场经济的发展而产生的新台阶，只有通过研究分析和恰当解决当前中国律师事业发展中出现的诸多问题，我国律师才能为国家21世纪的开放和发展提供有效的法律服务，为建立现代的国家司法体系作出自己应有的贡献。本文以“完善机制，拓展业务，提高素质，强化管理”为主线，在论述了当前律师业存在的诸多问题后，对律师的职业性质和执业责任赔偿作了论证，从“虚”和“实”两方面对律师运行机制的完善进行了阐释。在律师业务的拓展方面，本文第四部分着重论述了律师在刑事诉讼业务中的困境，同时分析了成因并提出了相应对策。本文第五部分从历史传统的角度和新世纪加入世界贸易组织的背景两方面对律师非诉讼业务的开拓作了重点分析，并由此论证了提高律师自身政治素质、业务素质的重要性，进而实现律师从个体意义上的现代化最终走向实现整个行业的现代化。最后，本文第六部分对律师管理体制作了论证，肯定了当前“两结合”的管理模式，并分别论述了三方面的管理内容。
Lawyer"s system is an important component of a country"s democratic system. The development of the Bar reflects the level of the civilization of law-government in a country. In the 21st century,the Chinese Bar are faced with the sustained development of the modernizations based on information and intellectual economy and new phenomena resulted from the further reform and opening as well as the development of market economy after our joining WTO. It is impossible for lawyers to provide effective legal service for the opening and development of the country and to make their own contributions to the modern judicial system unless a lot of problems appearing in the present Chinese Bar can be solved properly by careful research and analysis. The article follows the main thread of "perfect the system,expand the business,improve the quality and strengthen the management ". In addition to discussing many problems of the present Chinese Bar,this article tries to demonstrate the nature of the occupation as a lawyer and lawyer"s responsibility of compensation. It expounds how to perfect lawyer"s operating system both in ideological and practical aspects. In Part IV the author presents the troubles lawyers meet in criminal suits,analyses its reasons and puts forward corresponding solutions to that. In Part V the author analyses the development of the lawyer"s non-lawsuit business from the angles of the historical traditions and the background of joining WTO. Furthermore,it discusses the importance of improving the political and professional quality of lawyers. Only in this way can it be realized that lawyer"s individual modernization turns into that of the whole industry. Finally,in Part VI the article proves the system of lawyer management. On the one hand,the author affirms the pattern of the combining management by the judicial administrative department and lawyer"s association. On the other hand,the author discusses in detail the three aspects of management individually.
