论文标题:论船员人身伤亡损害赔偿及相关立法研究 Discusstion on Seafarer"s Personal Injury Compensation and Concerned Legislation 论文作者 论文导师 郭萍,论文学位 硕士,论文专业 国际法学 论文单位 大连海事大学,点击次数 99,论文页数 55页File Size2924K 2007-08-01论文网 http://www.lw23.com/lunwen_611671957/ Seafarer;; Crew Contract;; Personal injury compensation 船员在一个国家的经济发展中起着举足轻重的作用,国际海事组织是这样评价船员的:"没有船员的贡献,有一半世界在受冻,另一半世界在挨饿。"船员工作的高风险性和艰苦性要求特殊保护这一阶层在服务期间遭受人身伤亡索赔的实体和诉讼权利是必要的。 船员人身损害赔偿,具备一般人身损害赔偿的特征。根据责任主体承担人身伤亡损害赔偿责任的法律依据的不同,船员人身伤亡损害赔偿也可分为以合同关系提起的船员人身伤亡损害赔偿与以侵权关系提起的船员人身伤亡损害赔偿。该划分不是绝对的,因为船员人身伤亡损害赔偿在大多数情况,都存在着合同责任和侵权责任竞合的情形。 我国审判实践中对于船员人身伤亡损害赔偿,目前主要有三种赔偿标准依据。一种是按国内《工伤保险条例》来赔付;一种是《最高院关于审理人身损害赔偿案件适用法律若干问题的解释》;另外一种是《最高院关于审理涉外海上人身伤亡案件损害赔偿的具体规定》。上述几种法律基础、赔付范围和对船员的保护有所差异,在实践应用中也存在争议和不同。而即将于2007年9月1日生效的《中华人民共和国船员条例》旨在于为了加强船员管理,提高船员素质,维护船员的合法权益,保障水上交通安全,保护水域环境。无疑是我国在船员保护立法方面的一大进步。 我们通过国内实践,参考各国国内立法和国际公约,尤其是于2006年2月23日在日内瓦通过的《国际海事劳工公约》,借鉴其中对于船员人身保障方面的条款,以对于我国船员立法中船员人身伤亡保障提出建议。 Seafarers lead an important action in the economy of a country. One of the IMO officers said that" the half of the world would be cold, and the another half of the world would be hungry if no seaman"s work". So it is necessary for special protection on the proceedings and action for personal injury during services to seafarer. Seafarer"s personal injury compensation has the character of the general personal injury compensation. According to the law basis by which the litigant launched proceedings, seafarer"s personal injury compensation could be divided as the personal injury compensation by contract and by tort. Meanwhile which dividing is not unconditional, because in most situations there will be the concurrence of by contract and by tort. There are mainly 3 standard for trial practice in our country about seafarer"s personal injury compensation. One is , another is , the other is . Meanwhile, will become effective from the date of September 1 ,2007, the aim of which regulation is to strengthen the management and improve the working quantity and protect the legal rights of seafarer, also to improve the protection of the safety of water traffic and environment. Above mentioned regulation is undoubtedly the advancement of legal protection for the seafarer. Through the civil legal practice, with reference to the legislation of other countries and international convention, we would like to special mention the which was adopted on twenty-third day of February 2006, used reference to the clauses concerned, we put forward our suggestion of legislation for seafarer"s personal injury protection of our country.
