近年来,城市农民工社会权益的保护问题成为社会关注的焦点。中国的发展是和谐渐进的过程,要和谐,就必然要解决一些经济社会发展过程中的矛盾。处于弱势的群体——城市农民工,作为社会主体的一部分,他们生活的稳定、幸福是和谐社会必要的构件。因此从这个大的背景来看,关于城市农民工权益法律保护问题的选题很有现实意义。 本研究采用事例论证、理论研究、调查研究、比较研究、文献研究以及多学科渗透交叉的方法,在认识了解城市农民工权益保护的现状、研究成果和对现状的分析基础上,从历史的角度、比较的角度出发,分析目前我国城市农民工权益保护存在的问题及原因,并对城市农民工权益法律保护体系的整体构建进行探析。 城市农民工的基本特征是,人数众多,流入地集中在东南沿海和发达城市,高流动性、年龄构成轻,以青年男性为主;从业领域主要是建筑业,制造业,纺织业,服装业,服务业等,工资较低,工作条件较差,就业不稳定,没有任何保障。城市农民工基本劳动权益和休息权得不到切实保护,城市农民工的工资普遍偏低,与城市工人相比同工不同酬。基本没有什么社会保障,接受教育培训的机会少,劳动者的劳动技能普遍偏低。 农民工权益保护存在问题的原因是多方面的,其中主要是社会原因,包括企业方面、法律体系的不完备;社会保障制度和国家政策方面的原因以及历史遗留下的原因等。文章对城市农民工基本权益保护的必要性从发展生产力、市场经济健康发展、构建和谐社会以及法理意义等方面也做了阐述。 在城市农民工基本权益法律保护的路径上,本文做了较为详细的探索。首先是在法律运行过程中通过农民工在立法过程中的参与权的保护到普法工作的加强提出了自己的建议。其次在法律实现过程中,完善当前有关农民工基本权益保护的法律制度,加强法律执行过程中的保护和改革司法,切实做到农民工权益保护的落实。再次,在保护农民工基本权益过程中政府的角色如何强化,也提出了有现实价值的建议。最后从农民工组织建设和法律援助方面提出可供实施的方案。
The research of the legal protection on the basic rights and interests of the presents rural immigrant workers in China. In recent years, the legal protection on the basic rights and interests of the present rural immigrant workers has come to the front. The development of china is on the harmonious and gradual process. To be harmonious, the collision on the way must be compromised. As a minority group, rural immigrant workers" living stability and happiness has become indispensable for a harmonious society since they are one integral part of social body. From this big perspective, this topic will be very worthwhile. The methods of this research are based on real cases, theoretical study, comparative study, referential study and multidisciplinary connections. The purpose of this paper is to analyze the existing problems in the legal protection on the basic rights and interests of the present rural immigrant workers and its causes, and attempts to give an analysis to the construction of its legal system. The basic features of rural immigrant workers are: large quantity, the influx cities mainly lies in Southeastern seaside cities and developed cities, high frequency of mobility, and the majority of young males. Its engaging fields are: building, manufacturing, spinning and weaving, clothes and services. Its working conditions are bad, and also its employment is unstable, and there is no guarantee to be spoken of. The basic rights and interests can not get its concrete protection. The salaries is very low, and even the same job can not get the same payment compared with urban workers. They generally don"t receive any social security safeguard, little chance of receiving education, and also they are equipped with low levels of working skills Its causes lie in many ways, and the most important one is from society, which includes its inadequacy of legal system concerning enterprises, the social security mechanism and related national policies, and its historical leftovers. The paper necessitates the protections to advance the production forces, develop the market economy, and construct a harmonious society. This paper gives a detailed analysis in choosing the way to protect their basic rights and interests. First, the author gives his own advices on their participatory rights and the strengthening of popularizing law in the running process of law. Second, it is necessary to improve the legal system, and strengthen the protections and judicial reform to ensure the production can be carried out to the letter during the process of fulfillment. Thirdly, this paper gives valuable advice on how to solidify the role of government .Last but not least, a feasible plan is given on the organization building and legal assistance of rural immigrant workers.
