在物质文明和精神文明高度发达的今天,环境问题已成为制约人类社会进一步发展的首要因素。人类对其赖以生存的自然环境进行的无情破坏,无论是从深度上还是从广度上都达到了前所未有的程度,甚至已经危及到人类自身的存续。全世界的法学家都试图通过变革传统的法律制度,建立一套能够满足环境保护需要、抑制生态危机的全新的法律制度,形成了一股法律生态化的热潮。 在本文中,笔者试图从与环境保护关系最为密切的行政法入手,通过对行政立法的生态化改造,使其制定出来的行政法规、行政规章符合保护环境、防治生态危机的需要,也使行政主体在行使行政职权保护环境、防治生态危机时有法可依。 笔者首先分析了当前严峻的环境形势,阐述了行政立法生态化的概念和基本内涵,从理论基础和基本理念等方面论述了行政立法生态化重构的必要性和可行性。最后,笔者对行政立法生态化重构进行了具体的设想。 由于生态危机的成因十分复杂,涉及到人类社会乃至整个生物圈的方方面面,几乎人类所有的活动都与环境保护有着或多或少的联系,这些社会活动都有引发生态危机的危险。因此,环境保护是一个需要全社会共同努力才能完成的事业,它需要所有行政法规、规章协同配合才能实现对生态危机的有效防治。 本文的创造性成果主要是笔者将生态原则引入行政立法,并对行政立法的各个环节的生态化重构提出了一些具体设想,主要包括对行政立法基本理论的生态化阐释,对行政立法主体、行政立法技术、行政立法程序和行政立法监督等环节的生态化设想。试图建立一套能够制定符合环境保护需要的行政法规、规章的行政立法体系,为行政机关保护环境提供充分的法律依据。
High flourishing today in the material civilization and spiritual civilizations, the environment problem has become the check mankind"s initial factor of the social further development.Mankind as to it"s the heartless breakage that natural environment carry on that rely for existence, still is from the depth regardless to come to a the unprecedented degree up from the wide degree, even have already endangered mankind"s oneself to save continuously.The jurists of the whole world all try to pass to change the traditional law system, building up a set of all new law system that can satisfy the environmental protection demand and repress the ecosystem crisis, becoming the fever that a law ecology-ism.In this text, the writer try to commence from relate to the most close administration method with environmental protection, pass to the administration legislation of ecology-ism of the reformation, make the administration laws, the administration regulation meet the demand of the environmental protection, prevent and cure ecosystem crisis, also make the administration corpus professional make the administration job power for environmental protection and cure ecosystem crisis to have the method and can depend on.Because the origin cause of formation of the ecosystem crisis is very complicated, involve every aspect of human society and even the whole biosphere, nearly mankind all activities have connection more or less with environmental protection, these social activities all have danger of guiding hair ecosystem crisis. So, environmental protection is an undertaking needing the whole society to make joint efforts to could be finished, it needs all administrative statutes , rules to cooperate and realize the effective prevention and cure to the ecosystem crisis in coordination.Textual creative result is mainly some suggestions of writer to the administration legislation and turn the administration legislation ecosystem some to conceive in a specific way.Mainly include the basic theories problem to the administration legislation to elaborate, turn to conceive to the ecology-ism of the links, such as administration legislation corpus, administration legislation technique, the administration legislation, procedure and the administration legislation direct…etc..
