自一九一九年德国《魏玛宪法》开始，经济制度就成为宪法的一项重要内容。二战以后，通过宪法确立经济制度和经济原则，更成为世界各国立宪过程中自觉遵循的一条原则。我国现行宪法对经济制度作出了原则规定，并且在社会经济生活中发挥着重要作用。但随着我国加入WTO，以及社会主义市场经济体制的逐步完善，现行宪法的一些内容与现实经济生活逐步显现出不相适应的一面。因此，修改现行宪法，在宪法中确立与经济全球化趋势相适应的经济制度保障机制就成为一项刻不容缓的任务。本文试图从比较宪法学的角度阐明宪法意义上的经济制度，评析当今世界主要国家经济制度的宪法保障, 探讨我国现行宪法在经济制度保障上存在的不足及其原因，并提出加强和完善我国经济制度宪法保障的可行措施。本文包括三个部分。第一部分对经济制度的概念进行界定，并着重阐明经济制度宪法保障的意义。第二部分对德国、美国、英国、法国、日本经济制度的宪法保障进行比较研究，揭示出各国经济制度宪法保障的共性和规律。第三部分在对我国经济制度宪法保障的问题及其原因的分析的基础上，提出加强和完善我国经济制度宪法保障的措施。
Since Weimar constitution went into effect in Germany in 1919,economic system has been the most important content in constitutions. And after the WWⅡ, the principle that economic system and principles are established with constitution has been followed consciously by the countries when they drew up their constitutions. The existing constitution in our country has rules of economic system, and it works effectively in the social economic life. However, with our entering into the WTO and gradual improvement of our Socialism market economy, those contents in existing constitution fit the realistic economic life less well. Thus, amending the existing constitution and establishing a constitutional guarantee system that can apply to the globalization economic system have become an imperative task. The author attempts to state the constitutional economic system at the angle of comparative constitution, to evaluate the most industrial countries" economic guarantee. Then the author discusses the constitutional abuse and reasons on the economic guarantee in our country. Basing on the foregoing discussion, the author makes suggestions on how to reinforce and improve our country"s constitutional economic guarantee. This thesis consists of three parts. The first part is the definition of the economic system and the significance of the constitutional guarantee on the economic system. The second part is a comparative research of the constitutional guarantee on the economic system of Germany, the U.S., Britain, France and Japan, the author generalizes the characteristics in common and regulations of their constitutional guarantee on the economic system. The third part is based on the analysis of the problem and its reasons of our country"s constitutional guarantee on the economic system; the author puts forward the measures of improving our country"s constitutional guarantee on the economic system.
