论文标题:我国植物新品种保护现状与对策研究 Protection Condition and Research of Strategies of New Patenting Plants in China 论文作者 论文导师 杨为国,论文学位 硕士,论文专业 经济法学 论文单位 华中科技大学,点击次数 114,论文页数 43页File Size425K 2006-10-01论文网 http://www.lw23.com/lunwen_75381272/ new patterning plants;; Protection;;Strategies 植物新品种权是知识产权的一种形式,是实施国家知识产权战略和科教兴农战略的重要组成部分,是农业科技创新的重要原动力。为了积极应对加入WTO之后面临的挑战和机遇,有效构筑国家种子资源保护壁垒、促进我国农业科技自主创新,我国于1997年正式启动《植物新品种保护条例》,并在随后几年里制定了一系列规章制度和司法解释,确立了植物新品种保护制度,并开始为保障农业安全和促进农业经济发展发挥作用。由于植物新品种保护在我国还是新生事物,还在不断发展完善,通过多年的实践,我们发现现行的植物新品种保护制度还存在一定的缺陷,需要进一步修改完善。因此,开展对植物新品种保护的研究,对我国农业科技的保护和发展具有重要的现实意义。 本文通过对发达国家植物新品种保护经验较为系统的研究,充分分析我国在植物新品种保护方面存在的不足,认为我国现行的《植物新品种保护条例》仅是一项过渡性的措施,还有许多不完善的地方,需要由人大制定专门法,同时修改《专利法》,切实有效地保护育种人的合法权益。通过开展各种宣传推广活动,提高育种人的维权意识,保护科研积极性,促进农业科技创新,推进农业市场发展。本文从理论和实践的角度对以上观点进行了分析论述,以期对我国植物新品种权保护提供参考,有效构筑国家种子资源保护壁垒。 The right of new patterning of plants is one form of the intellectual property rights. The protection of new patterning of plants is an important part of the Intellectual Property Strategy and the Strategy of Revitalization of Agriculture with Science and also it is an important force to promote the innovation of agricultural science and technology. In April 23 1999, China has joined the International Union for the Protection of New Patterning of Plants (UPOV) and started the Regulations of the People’s Republic of China on Protection of New Patterning of Plants in order to meet the challenges and opportunities after the accession to WTO, construct the protective barriers of the seed resources and promote the innovation of agricultural science and technology. From then on, the protective policy began to help guarantee the agricultural safety and promote the economic development. Meanwhile, our country still has much to do in the protection of new patterning of plants. The Regulations is just the administrative rules issued by the State Council. If better protection is needed, a special law has to be adopted by the People’s Congress. The Regulations is transitional and imperfect, so it has to be improved. Learning from the experiences in the developed countries, studying the history and present condition in China, this thesis proposes some solutions to the problems existing in protection of new patterning of plants in our country.
