论文标题:论我国私营企业发展过程中的劳资关系 On Labor-capital in the Developing Process of China"s Private Enterprise 论文作者 郑钢 论文导师 李子猷,论文学位 硕士,论文专业 政治经济学 论文单位 陕西师范大学,点击次数 135,论文页数 55页File Size3455k 2004-04-01论文网 http://www.lw23.com/lunwen_781247927/ 劳资关系;私营企业;劳动者权益 labor-capital relations;private enterprise;laborers" right and interests 改革开放20多年来,我国私营企业的蓬勃发展对国民经济发展和社会稳定做出了巨大贡献,私营企业在国民经济中的地位日益提高。然而,我们在充分肯定私营企业发展所起的积极作用、鼓励私营企业发展的同时,也必须注意私营企业发展过程中出现的一系列问题,包括劳资关系问题。我国私营企业在劳资关系方面存在的诸多问题,其主要倾向,不是劳动者侵害私营企业主的权益,而是私营企业主侵害劳动者的权益。 现在的问题是,私营企业的劳资关系问题并没有引起我们足够的重视。许多人只看到私营企业发展的积极的作用,为推动私营企业的继续发展出谋划策,却忽视私营企业发展过程中在劳资关系方面存在的问题。对私营企业在劳资关系方面发生的问题,尽管新闻媒体进行了大量客观报道,但并没引起理论界尤其是经济学界的广泛关注,至今尚没有相关系统的而有说服力的研究。 因此,对私营企业的劳资关系问题进行认真而深入的理论研究是十分必要的。研究私营企业在劳动关系方面存在的问题,不仅需要从经济方面进行考察,也需要从法律、文化和道德方面进行考察。不仅应当说明私营企业劳资关系问题的现象形态,也应当分析问题产生的根源,更应当探究处理和解决问题的途径与方法。能否正确认识私营企业的劳资关系问题,能否正确处理和解决私营企业的劳资关系问题,直接关系到我国国民经济的顺利发展和社会安定团结的政治局面,必须引起我们高度的重视。 本文以私营企业劳资关系为研究对象,以马克思主义经济学为指导,研究的主要问题是:私营企业的发展过程、现状、性质、地位与作用;私营企业劳资关系问题的表现形式、产生的危害、发生的根源;国外调整劳资关系问题的成功经验,解决和调整我国私营企业劳资关系问题的对策。 本文的基本框架是:第一部分,阐述私营企业发展的历程和积极作用。主要介绍我国私营企业的发展过程、特殊性质、对国民经济发展和社会稳定的积极作用及其在国民经济中的地位。第二部分,对私营企业的劳资关系问题做行业分析。主要是通过典型案例,对我国各主要行业的私营企业中存在的侵犯劳动者权益的问题进行研究。第三部分,对私营企业的劳资关系问题做综合分析。主要是揭示我国私营企业中现存的劳资关系问题的基本表现形式、危害性、产生的根源以及应当如何正确认识等问题。第四部分,研究私营企业劳资关系问题的正确处理与健康发展问题。评价了外国处理劳资关系的成功经验,探索并提出了正确处理我国私营企业劳资关系问题的若千对策和方法。 本文的主要特点和个人见解是:由于理论界对私营企业劳资关系问题研究很少,仅有的一些研究,也只是局限于表面、局部的分析,缺乏深入、细致的研究。因此,较为全面、系统的研究我国现阶段私营企业的劳资关系问题,就成了本文的主要特点。本文中个人见解主要体现在以下几个方面:关于私营企业的界定问题—不管财产所有权是公有还是私有,只要由私人经营,就是私营企业;私营企业劳资关系问题表现形式—包括克扣劳动者工资、不签劳动合同、打骂劳动者等违法行为;私营企业劳资关系问题产生的根源—主要是私有资本的本性、劳动力市场供需不平衡以及法律不健全等因素造成的;关于危害性问题—私营企业劳资关系处理不好将直接影响经济和社会的发展和稳定;关于私营企业劳资关系问题解决的途径和方法—应从企业内外共同努力,建立相应的调整机制和方法。 With the 20 years" reform and opening-up policy, the prosperous development in China"s private enterprise has contributed greatly to the national economy and social stability, its role is becoming increasingly important. However, we must pay attention to a series of problems that occur in the course of its development, including labor-capital relations. The main tendency lies in the fact that it is not laborers who violate private managers" rights and interests but private managers who violate laborers" right and interests. This problem has not drawn enough attention. Although there is a wide range coverage on media, there is not a widespread concern in the academic circle, and the related systematic, convincing research is rather limited.Therefore, in order to make a careful and deep theoretical study on labor-capital relations is necessary. It should be done not only from the perspective of economy, but also from the perspective of law, culture and moral standards. Its phenomena and formation should be illustrated, its sources should be analyzed, its means and approaches to solving the problem should also be studied even more. Since it is directly related to the smooth development of our national economy and social stability, a great importance must be attached to.Taking labor-capital relations as the research subject, and Marxist philosophy as the guide, this thesis mainly research on the following questions: private enterprise"s developing process, present situation, nature, position and role; the form of expression, harm, source of problems arising from labor-capital relations; successful experiences as to how to regulate labor-capital relations abroad, the ways to deal with China"s labor-capital relations.The thesis is made up of four chapters. Chapter I introduces private enterprise"s developing process and active roles, mainly focusing on China"s developing process, special nature, active roles in the national economy and social stability and its important economic position. Chapter II make a detailed analysis on the violation of laborers" rights and interests in the main private enterprises in China though case studies. Chapter III makes a comprehensive analysis, aiming to expose the form of expression, harm,source of the problems arising from labor-capital relations and how to understand them positively. Chapter IV studies the proper ways to deal with labor-capital relations and their healthy development. This chapter also gives a review of successful experiences abroad on labor-capital relations and puts forward the possible ways and approaches to dealing with China"s private enterprise"s relations.The main characteristic of this paper and individual opinions are: Because theory circles study little on labor-capital relations of private enterprise, some research only confine to surface and some analysis are lack of deep, careful research. So, the comparatively overall, systematic study on the problem of labor-capital relations of private enterprise at the present becomes the main characteristic of this paper. The individual opinions mainly embody in the following several respects in the paper: definition problem about the private enterprise. Whether the ownership of the property is publicly- owned or privately owned, so long as managed by the individual, it is a private enterprise; Forms of expression of labor-capital relations of private enterprise, which includes illegal activities of pocket laborer salary, no signing labor contract and cursing and beat a laborer etc; Origin labor-capital relations of private enterprise come from, which affected by privately owned natural instinct, supply and demand uneven of labor power capital and imperfect law; about its harmfulness problem, for example, dealing bad with labor-capital relations of private enterprise will directly influence development and stability of economy and society; ways and methods to resolve the problem of labor-capital relations of private enterprise.
