语用学是专门研究语言在交际中的理解和使用的学问。翻译过程中的语用分析，就是借助语用学的理论和方法，对翻译中所涉及的语言使用问题进行交际意义上的综合分析。翻译是一种跨语言、跨文化的交流活动，意义上的最大等值是其追求的目标，而语用学正是对特定情景中特定话语意义的研究，因此把语用学引入翻译领域，用语用学的理论来指导法律英语的翻译，就会给翻译活动带来新的活力，使译文与原文达到语用上的等效。 本文应用现代语用学理论中的语境、指别、言语行为理论等，并结合法律语言学的研究成果，尝试从词汇、句法、语篇层面描述和分析《中华人民共和国海商法》英译本的语用特征，希望对理解和翻译法律法规文件有所帮助，对法律语言的研究有所启示。 本文总共分为三大部分。 第一部分是全文的开篇，包括两章内容。 第一章简单介绍一般翻译研究与语用学的发展现状，旨在说明语用学对翻译指导作用。第二章介绍法律英语的主要特征，且指出了其不同于一般题材的翻译特点。这些特点决定了法律翻译必须考虑语用因素。 第二部分是全文的重点，即法律翻译的语用分析。作者试从影响翻译的语用因素入手，对之做全面详尽的分析，这些因素主要包括言语行为理论，语境，和指别三个主要方面，因此这一部分分作三章，每一章针对一个语用因素进行分析，同时主要结合《中华人民共和国海商法》英译本，反映出语用理论对法律翻译的可借鉴价值。 最后第三部分是结论部分，在此作者明确观点：在法律翻译的实践中，要充分考虑语用因素。语用学理论虽不能指导整个法律翻译的活动，但其应用会对法律翻译的研究和发展起重大的推动作用。
Pragmatics is the study of meaning as communicated by a speaker (or writer) and interpreted by a listener (or reader). The pragmatic analysis of translation is an approach designed to comprehensively analyze language used by means of pragmatic theories. Translation is a cross-linguistic and cross-cultural communicative activity. Its aim is to achieve the maximal equivalence in meaning. This paper puts forward the pragmatic approach to legal English translation, generally speaking, to make maximal application of pragmatic principles both in the understanding phase and the reproduction phase in order to achieve pragmatic equivalent effect in legal English translation.This paper describes and analyzes the stylistic features of the English version of the Maritime Code of the People"s Republic of China at the lexical, syntactic, and textual level using the theory of modern pragmatics and the view of context, deixis and speech act theory. It is expected that these description and interpretation may shed some enlightening light for understanding and translating these codes and documents of other similarities, and will pose further research questions in the study of legal language.The paper includes three parts. The first part is an introduction, including two chapters. Chapter One provides a detailed introduction to the development of translation studies and pragmatic studies, indicating that the application of pragmatics to translation will shed new light on translation studies. Chapter Two is a tentative study on legal English and the development of legal translation. At the end of the chapter, the author concludes that a good translation of legal English should concern pragmatic elements. The second part constitutes the main body of this thesis. It provides a comprehensive pragmatic analysis of legal translation. By giving proper vivid examples, the author introduces some pragmatic theories including context, deixis and speech act theory. This part is composed of three chapters, and each chapter is a study on one theory. Most of these examples are originated from the English version of the Maritime
